Purchaser, by placing an order, makes an offer to purchase pursuant to these terms and conditions, which offer, if accepted by Looe Key Reef Resort, is accepted within the State of Florida, and purchaser consents to the jurisdiction of the courts of the State of Florida for the limited purpose of dispute arising between the parties resulting from this transaction and agrees that the laws of the State of Florida shall apply.
By opening or using a product purchased from Looe Key Reef Resort, the purchaser agrees to be bound by the term and conditions of sale as set forth below. If you do not agree to the terms and conditions of sale, please ship the product back to Looe Key Reef Resort unopened within 5 days of receipt for a full refund (less shipping and handling charges).
Looe Key Reef Resort makes no warranty, either expressed or implied, of merchantability or fitness for any particular purpose, and none shall be implied by law.
Final determination of suitability of any item sold for the use contemplated by purchaser is the sole responsibility of the purchaser, and Seller shall have no responsibility in connection with such determination.
Looe Key Reef Resort will not be responsible for any consequential or incidental damages resulting from the sale, non-delivery, use or improper function of any equipment purchased from us. The responsibility, if any is imposed, of Looe Key Reef Resort in regard to any item purchased shall be limited to the monetary value of the merchandise purchased.
Looekeyreefresort.com is intended to be a guide only. Some item illustrations are for display purposes only, may not be exact, and are not necessarily included in the purchase price. Looe Key Reef Resort is not responsible for typographical or pictorial errors, and specifications may change without notice.
All items offered for sale are subject to availability. Many items on our Web site or catalog site come from various sources. Looe Key Reef Resort is, therefore, bound to fluctuating currency exchange rates, making it necessary to occasionally increase prices. In addition, some domestic and overseas products may be discontinued without our prior knowledge. Should this apply to your order, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
We make every effort to provide you with an error-free Web site. However, in the event there is a misprint, we reserve the right to correct copy or pricing to reflect the actual current status.

At times, we may experience a shortage of certain items. At these times, we reserve the right to restrict the quantity of a particular item ordered. We will notify you if a situation like this occurs, In addition, Looe Key Reef Resort may, at its own discretion, limit quantities sold in each order or to each person or household.
Some items, marked as such, are intended solely for use by students, teachers, or faculty members at educational institutions. Upon order of these items, Looe Key Reef Resort may request verification of educational status (e.g. student ID).
We do not sell to those who intend to resell products offered through LeisurePro.com, including dealers, resellers, exporters, wholesalers, or customers. Looe Key Reef Resort reserves the right to decline or cancel an order at any time.

RETURN AND EXCHANGE POLICIES
While we believe that the best way to ensure the best product and fit is to purchase your diving equipment is with the in-person assistance of one of our equipment experts, we realize that is not always possible.
But, we still want you to be happy and satisfied with any products purchased online from Looe Key Dive Center. So, if you're not satisfied with your purchase for any reason, simply return the unused product within 30-days from the original invoice date for a full refund or you can exchange it under our 30-Day Satisfaction Guarantee. You have another 30 days (60 days total) to exchange or return for a store credit. Original shipping charges are not refunded.
CONDITIONS ON ALL RETURNS
All returned items must be new and unused with original manufactures labeled packaging along with all parts, materials, manuals, and blank warranty cards, etc.
No returns or exchanges on opened books, CDâs, or DVDâs.
No returns or exchanges on âhygieneâ items such as mouthpieces, snorkels, or swimsuits once used.
No returns or exchanges on special orders, closeouts, or clearance items.
Policy does not apply to commercial or bulk orders.
Valid Return or Exchange Period. All time periods to qualify for returns or exchanges begin with the date of the original purchase invoice. For Christmas Holiday gifts purchased between November 1 and December 31, returns/exchanges may be made until following January 31.
Shipping. Customer pays return shipping to us. We advise using a method which provides tracking and insurance. We are not liable for returns that do not reach us. We will pay for shipping of the replacement item to you. We can only provide shipping to the 48 contiguous US states.
Defective Items may be returned for an exchange or refund and must be returned with original manufactures labeled packaging with all parts, materials, manuals, and blank warranty cards, etc.
Incorrect Items. If you ordered the incorrect item, simply follow the standard return procedures (standard shipping policy applies). If we sent you the wrong item, we will credit your shipping costs as well as provide shipping for the correct item.
Perfect Fit. If it doesnât fit, weâll exchange for the same item in a different size (standard shipping policy applies). Item must be brand new and unused. Exchange must be requested within 30 days of the invoice date.
RETURN ITEM AS âUSEDâ
Did you already use the product but still want to return it? We allow many qualifying items to be returned for store credit even if used, up to 60 days from the invoice date. Items must be in as-new-condition and returned with original manufactures labeled packaging with all parts, materials, manuals, and blank warranty cards, etc. We reserve the right to refuse the return if not in as-new condition in our sole judgement.
Qualifying Items: Buoyancy Compensators, Regulators, Alternate Air Sources, Computers, Gauges, Mask, Fins, Lights, Knives, and Reels.
Returning a âUsedâ Item. Call us to start the process. You will also need to send us a detailed description of the item along with photographs to make an initial determination if the item may be returned.
RETURN / EXCHANGE PROCESS
Call us at 305-872-2215 or email us at firstname.lastname@example.org to obtain a Return Material Authorization (RMA) number. This numbers helps us quickly track the status of your order.
Simply return the unused product in its original packaging, copy of invoice, and all materials, manuals, and blank warranty cards.
Write the RMA number clearly on the outside of the shipping box.
Be sure to use a shipping service that can provide package tracking.

When we receive your return, we will credit the payment method used to make the purchase, excluding the cost of shipping. Looe Key Reef Resortâs refund policy does not include the cost of shipping your purchase back to Looe Key Reef Resort. Please allow seven days for the refund to be processed.
